SECTION 1 — GENERAL TERMS, GOVERNING LAW & DEFINITIONS

Governing Law & Jurisdiction

All services, interactions, agreements, bookings, and disputes involving 1RM Massage are governed exclusively by the laws of the Province of Alberta, including the Health Information Act (HIA), Personal Information Protection Act (PIPA), Occupational Health & Safety Act, and all applicable massage therapy standards. The client agrees that any dispute or legal proceeding shall be brought solely before the courts of Alberta and irrevocably submits to their jurisdiction. No other jurisdiction shall apply.

Definitions

“1RM Massage”: The business, its owner(s), employees, contractors, and representatives. “Therapist”: Any massage therapist or practitioner providing services on behalf of 1RM Massage. “Client”: Any individual booking, receiving, or paying for services from 1RM Massage. “Premises”: Any location where services are provided, including the client’s home, workplace, gym, hotel, or other designated space. “Services”: Any massage, stretching, mobility, red light therapy, infrared therapy, or wellness service provided by 1RM Massage.

SECTION 2 — SCOPE OF SERVICES, DISCLAIMERS & ASSUMPTION OF RISK

Nature of Services

1RM Massage provides non‑medical, non‑diagnostic wellness services including massage, mobility work, assisted stretching, red light therapy, and infrared therapy. Therapists do not diagnose medical conditions, prescribe treatment, perform spinal adjustments, or provide medical care. Services are intended for general wellness, posture support, stress reduction, mobility, and muscular recovery.

No Medical or Outcome Guarantees

1RM Massage does not guarantee specific results, pain relief, injury resolution, or performance improvement. Services are not a substitute for medical evaluation, physiotherapy, chiropractic care, or emergency treatment. Clients are responsible for consulting a physician for any medical concerns.

Assumption of Risk

By booking or receiving services, the client acknowledges and voluntarily assumes all risks associated with massage, stretching, mobility work, and light‑based therapies, including temporary soreness, discomfort, dizziness, emotional release, aggravation of existing conditions, or unexpected reactions.

SECTION 3 — CLIENT RESPONSIBILITIES, DISCLOSURE & COOPERATION

Mandatory Health Disclosure

Clients must disclose complete and accurate information regarding injuries, surgeries, chronic conditions, cardiovascular or neurological issues, pregnancy, medications, allergies, recent accidents, and any changes in health status. Failure to disclose relevant information releases 1RM Massage from all liability.

Client Cooperation

Clients agree to communicate discomfort, pain, dizziness, numbness, or emotional distress immediately during treatment. Clients agree to follow therapist instructions at all times.

SECTION 4 — INFORMED CONSENT & RIGHT TO REFUSE SERVICE

Informed Consent

By receiving services, the client confirms they have read and understood this document and provide voluntary, informed, and ongoing consent to treatment.

Therapist’s Right to Refuse or Terminate Service

1RM Massage may refuse or terminate a session if the client is under the influence of drugs or alcohol, behaves inappropriately, creates an unsafe environment, presents contraindications, or violates this Policy. Sessions terminated for these reasons are non‑refundable.

SECTION 5 — MOBILE SERVICE ENVIRONMENT & SAFETY

Client’s Responsibility for Environment

Clients must provide a safe, clean, hazard‑free, temperature‑controlled environment with adequate space for equipment setup and therapist movement. 1RM Massage is not responsible for injuries or damages caused by environmental hazards, unstable furniture, slippery floors, clutter, or unsafe conditions.

Pets, Children & Third Parties

Clients are responsible for managing pets, children, and other individuals present during the session. 1RM Massage is not liable for incidents caused by third parties or animals. If disruptions occur, the therapist may terminate the session and the full fee may apply.

Access, Parking & Building Conditions

Clients must ensure safe access to the premises, including stairs, elevators, hallways, and parking areas. 1RM Massage is not responsible for injuries or damages occurring in common areas or building access points.

SECTION 6 — SERVICE‑SPECIFIC CONSENT & DISCLAIMERS

Massage Therapy

Massage may cause temporary soreness, redness, or discomfort. Clients understand that massage is not intended to diagnose, treat, or cure medical conditions.

Assisted Stretching & Mobility Work

Stretching involves passive and active movement of joints and muscles. Risks include muscle strain, joint discomfort, cramping, or aggravation of preexisting conditions. Clients must communicate limits clearly and may request modifications at any time.

Red Light Therapy (RLT)

RLT is a wellness modality and not a medical treatment. It is not intended to diagnose, treat, cure, or prevent any disease. Potential risks include temporary warmth, redness, irritation, or photosensitivity. Clients must disclose medications that increase light sensitivity (e.g., certain antibiotics, retinoids, diuretics).

Infrared Therapy

Infrared therapy produces heat and may increase circulation. Risks include overheating, dehydration, dizziness, or irritation. Clients must disclose cardiovascular conditions, heat sensitivity, or use of medications affecting thermoregulation.

SECTION 7 — FEES, PAYMENTS, CANCELLATIONS & REFUNDS

Payment Terms

Payment is due at the time of service. Chargebacks for services rendered may result in refusal of future service and legal action to recover fees.

Cancellation & No‑Show Policy

Cancellations require 24 hours’ notice. Late cancellations or no‑shows may be charged 100% of the session fee. Repeated violations may result in refusal of service.

Refund Policy

No refunds for completed services. Packages, memberships, and promotions are non‑refundable. Transfers may be allowed at the discretion of 1RM Massage.

SECTION 8 — PROFESSIONAL BOUNDARIES & ZERO‑TOLERANCE POLICY

Professional Conduct

Sessions are strictly non‑sexual. Any inappropriate behavior results in immediate termination and possible permanent refusal of service.

Recording & Privacy

Recording or photographing the therapist without consent is prohibited. Violations may result in termination of service and legal action.

SECTION 9 — LIMITATION OF LIABILITY & INDEMNIFICATION

Limitation of Liability

To the fullest extent permitted by Alberta law, 1RM Massage is not liable for:

  • Injuries resulting from undisclosed medical conditions

  • Injuries caused by environmental hazards in the client’s location

  • Reactions to oils, lotions, or equipment

  • Aggravation of preexisting conditions

  • Indirect, incidental, or consequential damages

  • Client failure to follow instructions

  • Injuries caused by third parties or pets

  • Accidents occurring in hallways, stairs, elevators, or parking areas

Indemnification

The client agrees to indemnify and hold harmless 1RM Massage from any claims, damages, losses, liabilities, or expenses arising from:

  • Failure to disclose medical information

  • Unsafe conditions in the client’s environment

  • Misuse of equipment

  • Violations of this Policy

  • Actions of third parties present during the session

SECTION 10 — PRIVACY POLICY (PIPA + HIA COMPLIANCE)

Information Collected

Personal information: name, phone, email, address, emergency contact. Health information: medical history, injuries, medications, allergies, pregnancy status, treatment notes. Technical information: IP address, cookies, booking data.

How Information Is Used

To assess treatment safety, provide services, schedule appointments, process payments, maintain records, and comply with legal requirements.

Storage & Security

Records are stored securely in encrypted digital systems or locked physical files. Access is restricted to authorized personnel only.

Retention & Destruction

Records are retained for at least 7 years after the last treatment. Records for minors are retained for 7 years after the client turns 18. Destruction is performed securely.

Sharing of Information

Information is shared only with client consent or when required by law. Third‑party platforms may access limited information solely to perform their functions.

Client Rights

Clients may request access, corrections, withdrawal of consent, or deletion where legally permissible.

Breach Protocol

Clients will be notified of any breach as required by law. The OIPC will be notified when applicable.

SECTION 11 — CONSENT TO TREATMENT & DATA USE

By receiving services, the client consents to treatment, data collection, secure storage, and communication via SMS or email for administrative purposes. Marketing communication requires separate opt‑in.

SECTION 12 — SEVERABILITY, MODIFICATIONS & ENTIRE AGREEMENT

If any provision is found invalid, the remaining provisions remain in effect. 1RM Massage may update this document at any time. This document constitutes the entire agreement between 1RM Massage and the client.
